On the Massachusetts ballot this November is a question which is of importance to all of us who would like to see the Commonwealth remain as inclusive as possible to the transgender community. In July 2016, Massachusetts passed a law —Senate Bill 2407 (SB 2407)—that prohibited discrimination based on gender identity in public businesses or other places open to the general public, such as hotels, stores, restaurants, theaters, sports stadiums, and hospitals. Question 3 asks whether this law should be upheld. A “Yes” on Question 3 is a vote to uphold vital protections for transgender persons in Massachusetts public accommodations.
“Gender identity” is currently defined as a person’s sincerely held gender-related identity, appearance, or behavior, whether or not it is different from that traditionally associated with the person’s physiology or assigned sex at birth. The public accommodations protections passed in 2016 not only ensures that a transgender individual can use the bathrooms that align with their gender identity, but also ensures equal protection for transgender individuals in all public accommodations.
